Pfizer has been accused of selling Viagra under the brand name Cialis, and that its products were “inappropriate for sale to patients.”
The drugmaker is also ordered to pay a $5.6 million fine by the Federal Food and Drug Administration.
The Food and Drug Administration approved Pfizer’s drug erectile dysfunction drug Viagra in November 2017. It was the first of a new class of prescription drugs to be approved by the FDA, called Phosphodiesterase type 5 (PDE-5) inhibitors.
Viagra and Cialis are the only PDE-5 inhibitors on the market. The FDA said the drug’s label also listed the generic names of the active ingredient in Viagra and Cialis.
“The FDA has not approved this use of erectile dysfunction drugs in the United States and other countries,” the agency said in a statement. “This new use of Pfizer’s Cialis is a violation of the federal Food, Drug, and Cosmetic Act.”
In May, the FDA ordered a second trial of Viagra, saying it failed to demonstrate that it had the “highest success rate” of Viagra and Cialis in achieving its market share. The FDA later said the results of the study did not meet its requirements.
In November, Pfizer posted a $6.5 million fine and a $2.1 million fine for promoting Viagra. Cialis also made it available only in the United States.
The FDA said the drug company received a “black box” warning letter from the U. S. Food and Drug Administration on the product’s label.
The FDA said the company was “inappropriate for sale to patients” in the United States, while the warning label had a “black box” language on it.
In the case of Cialis, the label was “not applicable,” according to the FDA. However, Pfizer has agreed to resolve the matter and is asking the FDA to resolve the matter with the U. Food and Drug Administration.
The FDA had not responded to a request for comment from the press.
The case is being investigated by a number of federal prosecutors. A federal judge is expected to hear the case in July.
